The company Františkovy Lázně AQUAFORUM a.s., Company Registration Number: 10989391, with its registered office at 5. května 106/9, 351 01 Františkovy Lázně, www.frantiskovylazne.cz, email: [email protected], registered in the Commercial Register maintained by the Regional Court in Plzeň, Section B, File 2140 (hereinafter referred to as the “Company”) is a company whose business activities include, among other things, providing accommodation services (hereinafter referred to as the “services”).
A guest is a person who is the end recipient of the Company’s services (hereinafter referred to as the “guest”).
These accommodation rules apply to all accommodation facilities operated by the Company (hereinafter referred to as the “hotel”).
GUEST ACCOMMODATION
Upon receipt of a valid booking for the services (within the meaning of clause 3.9 of the Company’s General Terms and Conditions, hereinafter also referred to as the “GTC”), the hotel is obliged to accommodate the guest on the day of their arrival from 2:00 p.m. at the earliest and by midnight at the latest, unless otherwise stated in the booking confirmation.
In accordance with generally applicable legal regulations, the hotel is authorised to accommodate only guests who have been duly registered. To this end, the guest shall present their valid identity card, passport or other valid photo ID to the relevant hotel staff member immediately upon arrival and complete a registration form. If a guest fails to produce a valid identity document, the hotel is entitled to refuse accommodation to the guest; in such a case, the guest is not entitled to any compensation for unused services.
Upon check-in, the hotel shall issue the guest with a hotel card stating the name of the hotel, the guest’s name, the room number and the duration of the stay, as well as the meal plan, if applicable. The guest is obliged to familiarise themselves with these accommodation rules and with the safety and evacuation information displayed in the hotel, and to comply with the applicable requirements.
ARRIVALS AT THE HOTEL
When returning to the hotel, a registered guest must, upon request, present a valid hotel card or treatment card to a member of staff. The same applies when a guest requests keys (for a room, bicycle storage, etc.) at reception. The guest is obliged to prevent damage to, loss of or destruction of keys, the hotel card and the treatment card.
The hotel entrance is locked between 10:00 pm and 6:00 am. For security reasons, any guest entering the hotel while the entrance is locked must present their hotel card or another form of identification to a member of the reception staff. Reception staff may verify the guest’s details in the hotel database. During these hours, reception staff may also ask guests moving about the hotel at night or in the early hours to show their hotel card. In case of doubt, reception staff may request assistance from the Municipal Police or the Czech Police.
USE OF THE ROOM BY THE GUEST
The guest shall use the room for the period specified by the hotel or the Company. Unless the length of stay has been changed by agreement with the hotel or at the guest’s request, the guest shall check out by 10:00 at the latest on the final day of their stay and is obliged to vacate the room by this time. If the guest fails to do so, the hotel is entitled to charge a late check-out fee. In the event that the hotel has already reserved this room for another guest and the guest fails to comply with a request or is not present at the hotel, the guest hereby consents to the hotel being entitled, in the presence of a three-member committee, to make an inventory of the guest’s belongings and place them in a secure storage so that the room may be used by the guest who has reserved it.
If a guest requests an extension of their stay, the hotel is not obliged to automatically extend the stay; however, if the hotel has a vacant room, it may offer it to the guest (the room may be different from the one in which the guest was originally accommodated).
In justified exceptional cases, the hotel may accommodate the guest at another hotel operated by the Company, in a category equivalent to or higher than the one originally agreed, whilst maintaining at least the same standard and price of services.
DAMAGE TO HOTEL FURNISHINGS
For safety reasons, the guest is obliged, whenever leaving the room, to turn off the taps, switch off the lights in the room and the adjacent areas, disconnect any personal electrical appliances permitted by the hotel from the power supply, switch off the television, lock the room’s entrance door and, depending on current weather conditions, secure any open windows to prevent damage to the property of either the hotel or the guest.
Guests must not, without the hotel’s consent, move or modify any furnishings or equipment in the room or on the hotel premises, nor must they carry out any work on the electrical system or other installations.
In the event of soiling or damage to room or hotel facilities requiring special cleaning or repairs, the guest is obliged to pay the costs associated with carrying out such cleaning or repairs.
STAYING WITH PETS
Staying with a pet (e.g. a dog or a cat) is only permitted if the hotel allows such stays or if the hotel management grants its consent. The hotel is entitled to assess the suitability of a particular pet for a stay at the hotel and to refuse to allow the pet to stay, particularly regarding its species, size, number, state of health, as well as the safety and comfort of other guests. The pet’s owner agrees and undertakes to comply with these rules for accommodation with pets. The pet owner bears full responsibility for the pet’s behaviour on the hotel premises, on the hotel grounds and in the immediate vicinity, and is fully liable for any damage caused by the pet to the property of the hotel, the Company or third parties. A fee for staying with pets is always charged in accordance with the current price list.
Pets are prohibited from entering areas of the hotel where their presence is not expressly permitted. This restriction does not apply to areas designated for pets.
Only the designated entrance may be used to enter the hotel with pets.
In all public areas of the hotel where pets are permitted, every pet must be kept on a lead or confined in a suitable pet carrier or crate.
Exercising or relieving dogs and other animals anywhere on the hotel grounds is strictly prohibited.
Pet owners are always obliged to clean up after their pets, not only on the hotel premises but also in the immediate vicinity.
The pet owner is obliged to ensure that the pet does not disturb other hotel guests in any way, e.g. by barking, howling, odours, etc.
In the event of any damage to the hotel’s property, the pet owner is obliged to pay for the damage incurred in full.
The pet owner must allow the housekeeping service to clean the room in such a way as to ensure that staff are not put at risk during cleaning, between 10:00 a.m. and 12:00 noon or 1:30 p.m. and 3:00 p.m., at least twice a week.
In the event of non-compliance with or breach of the above rules and measures, the pet owner will be charged an additional fee for the extra cleaning of the room or other areas soiled or damaged by the pet.
If a pet causes a nuisance to hotel guests, damages hotel facilities or equipment, or otherwise fails to comply with the rules governing the movement and stay of pets in the hotel, the guest’s stay may be terminated without entitlement to any compensation.
THE HOTEL’S LIABILITY FOR DAMAGE TO A GUEST’S PROPERTY
The hotel is liable for damage to items which the guest has stored during their stay in the room allocated for accommodation or in any other place expressly designated by the hotel for the storage of guests’ belongings (e.g. luggage storage, bicycle storage or other similar areas). The hotel’s common areas, in particular corridors, the reception area, the entrance hall, restaurants, lounges and other similar areas, are not considered to be designated storage areas. The hotel’s liability does not extend to motor vehicles, items left inside them or live animals.
The extent of the hotel’s liability for items brought into the hotel premises, including the statutory limitation on the amount of compensation for damage, is governed in particular by Sections 2946 to 2949 of the Civil Code. At the same time, where the daily rate of accommodation within the meaning of Section 2948(1) of the Civil Code is not the same for every day of the stay, the relevant daily accommodation rate shall be the rate in effect on the day on which the damage occurred.
The guest is obliged to act in such a way as to prevent damage to their property. In particular, they are obliged to lock the entrance door properly whenever they leave the room, not to leave valuables or other items of value freely accessible and, where reasonably possible, to store valuables in the in-room safe or use the hotel’s safekeeping service. The guest is obliged to report the loss, damage or theft of any item to the hotel without undue delay after they have had the opportunity to discover such loss, damage or theft. A breach of these obligations may affect the extent of the hotel’s liability in accordance with the law.
The hotel may accept cash, jewellery or other valuables for safekeeping, unless such items are hazardous or their value or volume is disproportionate to the hotel’s capacity. A written record of the safekeeping of the item must be drawn up and signed by both the guest and an authorised member of the hotel reception staff; the record shall, in particular, describe the item being held, including a statement of its value. Placing an item in the luggage storage facility or leaving it in a safety deposit box located in the guest’s room does not constitute safekeeping. The hotel is not obliged to accept for safekeeping from a guest any cash, jewellery or other valuables with a total value exceeding EUR 10,000 (in words: ten thousand euros).
USE OF PERSONAL ELECTRICAL APPLIANCES
Guests are not permitted to use their own electrical appliances in the hotel, particularly in their rooms, including electric heaters, kettles, portable cookers and similar items. This does not apply to electrical appliances used for personal hygiene (shavers, massagers, hairdryers, etc.), personal computers, tablets and mobile phones. We recommend that you consult the hotel reception regarding the use of these or any other specific appliances.
ACCESS TO THE HOTEL AND CAR PARKING
On the hotel premises and grounds, guests and other persons are required to comply with traffic regulations, observe traffic signs and follow the hotel’s instructions.
Vehicles may only be parked, subject to a charge in accordance with the current price list, in parking spaces assigned by reception or in other areas designated by the hotel for the parking of guests.
PROCEDURE IN THE EVENT OF A GUEST’S ILLNESS OR INJURY
In the event of a guest suffering an acute illness or injury, the hotel will arrange for first aid to be provided, call emergency medical services if necessary and, where appropriate, notify the person or persons named by the guest in the consent form regarding the disclosure of health information provided on arrival, to the extent and in the manner specified by the guest in that document.
NIGHT-TIME QUIET HOURS
Between 10:00 pm and 6:00 am, guests must observe the night-time quiet hours, i.e. they must not disturb other guests staying at the hotel. Compliance with the night-time quiet hours also applies to guests using the outdoor areas of the hotel grounds, such as terraces, gardens, etc.
SMOKING AND HANDLING OPEN FLAMES
Smoking, handling or otherwise using open flames or handling any hazardous substances is prohibited throughout the hotel premises and on room balconies. Smoking is permitted only in designated areas. The hotel is under no obligation to provide designated smoking areas.
USE OF AND PAYMENT FOR HOTEL SERVICES
Guests are obliged to pay for accommodation and other services booked in accordance with the contract and the General Terms and Conditions in the amount of 100 % of the total price no later than upon arrival. Guests are also obliged to pay the local accommodation tax and any other charges specified in the pricing terms, the booking confirmation, or as stipulated by generally binding legal regulations, municipal by-laws, etc.
If, during their stay, a guest makes use of services that have not been paid for in advance, they are obliged to pay for these services in cash or by payment card at the time of use or, at the latest, on departure at the hotel reception. The bill is due upon presentation.
GUEST VISITORS
Guests may receive visitors in their rooms. Visitors are not entitled to use hotel services which are provided exclusively to registered guests or are included in the price of their stay, unless they book and pay for them separately.
Guests are required to notify reception in advance if a person who is not registered as a hotel guest intends to stay overnight. Overnight stays by visitors are not permitted without the hotel’s consent. If a visitor makes use of accommodation or other hotel services (in particular an overnight stay), they are obliged to comply with the conditions set by the provider for the provision of such services, in particular to make a booking for their stay, to enter into a contract for the relevant services, to pay the price for the services provided, and to comply with the accommodation rules to the extent corresponding to the services used.
FINAL PROVISIONS
Throughout their stay, guests must conduct themselves in such a way as not to cause harm to the rights, life, health or property of others. Any damage caused by a guest shall be compensated by that guest to the extent and in the manner set out in the General Terms and Conditions, these accommodation rules and generally binding legal regulations.
The hotel reserves the right to refuse or immediately terminate accommodation, as well as to refuse the provision of all services and to prohibit the stay at the hotel of persons whose behaviour, appearance or conduct do not conform to the usual standards expected at a spa hotel, and furthermore of persons who:
- engage in conduct which, to an extent exceeding what is customary, cause a nuisance to other hotel guests or cause offence to them;
- disrupt the smooth running of the hotel or the working conditions of the staff;
- use or distribute narcotic or psychotropic substances;
- are under the influence of alcohol, narcotic or psychotropic substances, or show obvious signs of being in such a state;
- engage in door-to-door sales or any other unauthorised commercial activity;
- harass other persons through gestures, sexual advances and similar behaviour, including the offering of sexual services;
- use the hotel’s common areas for purposes other than those for which they are intended;
- fail to comply with the hotel’s operating instructions, including those set out on signs displayed throughout the hotel premises.
Guests are obliged to comply with these accommodation rules and any other instructions displayed on the hotel premises. Should they breach these rules, the Company reserves the right to terminate the contract for the provision of services before the agreed period of stay has elapsed and to claim compensation for any damage incurred.
Our aim is to ensure you enjoy undisturbed relaxation, safety, peace and quiet, and an improvement of your health. By respecting these accommodation rules, you are helping us to maintain the quality of the services we provide to all our guests.
